Talent Link Global Company Limited (“Talent Link,”) is a psychological assessment and coaching consultancy company that has researched and developed certain products and services, including personality, leadership, and wellness assessments and related reporting, training, and coaching services. This website and any related websites (“the Website”) and the services available through the Website are operated by Talent Link. These Terms of Service constitute a legal agreement between you and Talent Link. The Website offers you to purchase Talent Link’s products and/or services. All contents, information, products, and services provided on and through the Website solely under the following terms and conditions (“Terms of Service”). By accepting such contents, information, products and/or services, you agree to these Terms of Service. 

Please read through the Terms of Service carefully before you start to use the Website. By accessing and using the Website or any online account you create on the Website, you accept without modification all the terms, conditions, and notices contained in the Terms of Service. If you do not agree to the Terms of Service or the Talent Link Privacy Policy, you must not access or use the Website. Accordingly, under the General Data Protection Regulation, or “GDPR,” users in the European Union (“EU”) acknowledge and consent to Talent Link’s processing of personal data by Talent Link as necessary for the legitimate interest of performing Talent Link’s services to you.

All content and information presented on or through the Website including but not limited to, text, photos, videos, graphics, survey, or reports are made available solely for general information purposes. Talent Link does not warrant or guarantee the Website will be error-free, accuracy, completeness, adequacy, or usefulness of this information. Talent Link does not warrant or guarantee the Website free of viruses or other harmful components. You access the Website and use of the contents on or through the Website is strictly at your own risk. Talent Link disclaims all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

The Website may provide links to websites developed, controlled or operated by persons and companies other than Talent Link. Talent Link is not responsible for and assumes no liability for any third-party websites and contents. Talent Link is not responsible for any viruses, malware, or other harms resulting from your use of a third-party website. You are responsible for locating, viewing, and adhering to the Terms of Service and Privacy Policies of each third-party website you visit. You are solely responsible for any dealings with third-party websites, including the delivery of and payment for goods and services. 

Limitations on Uses 

The contents on the Website are intended to provide information only and are solely for your personal and non-commercial use. You may use the Website for your own personal use or your organization’s internal use only. You may not sublicense, transfer, decompile, sell, lease, or otherwise make available any of the content to any third party for commercial purposes. You may not reproduce, modify, print, copy the Website or the content without prior obtaining written permission from the Talent Link. You may not extract information about usage or users. Any unauthorized use of the Website or the content is prohibited.

• Extract information about usage or users. Any unauthorized use of the website or the content; 

• Attack the Website via a denial-of-service attack or a distributed denial-of-service attack; or 
• Impersonate or attempt to impersonate Talent Link, an employee of Talent Link, another user or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing). 

Intellectual Property Notices: The content and the Website are protected by copyrights and trademark are subject to other proprietary rights. This means that anyone using the Website is not permitted to use the content in any manner, except as expressly provided by Talent Link in the Terms of Service.  Accordingly, any unauthorized use of the Website or the content may violate copyright laws, trademark laws, patent laws, trade secret laws, or laws relating to privacy and publicity.  

Responsibility on User Account 

If you are given or create a password to access the Website, you are responsible for maintaining the confidentiality of your account and your password. You are responsible for all activities that occur under your account, and you agree to notify Talent Link immediately of any unauthorized use of your account. Talent Link is not responsible for any loss that you may incur as a result of any unauthorized person using your account or your password. You are responsible for all uses of your account, whether or not actually or expressly authorized by you. Talent Link reserves the right to refuse and cancel registrations or subscriptions. 

Privacy and Personal Information: You may be required to register to use the Website. To set up an account, you may be required to provide information about yourself. Additionally, data pertaining to your online transactions and usage may be collected, analysed, and stored by Talent Link. Talent Link agrees that it will only use and/or disclose your personal information in accordance with the terms of the Privacy Policy (“the Privacy Policy”). The Privacy Policy is hereby incorporated by reference into the Terms of Service. By agreeing to the Terms of Service, you are also agreeing to the Privacy Policy. In accessing and using the Website, you accept without modification all of the terms, conditions, and notices contained in the Privacy Policy.

Your use of the Website is subject to the Privacy Policy, which is available on the Website. 

Governing Law & Jurisdiction 

The rights and obligations of the parties to the Terms of Service are governed by the laws of Hong Kong. You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Hong Kong for any claims arising hereunder or relating to the use of the Website and the contents. 

Arbitration 

Any disputes arising from the use of the Terms of Service or the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre under the Hong Kong International Arbitration Centre Administered Arbitration rules in force when the Notice of Arbitration is submitted. By using the Website, you hereby consent to submission of any dispute to final and binding arbitration. 

Limitation of Warranty  

Talent Link expressly disclaims all warranties and conditions, express or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. No warranty is given that the operation of any software shall be uninterrupted or error free. Talent Link makes no representations or warranties about the accuracy, reliability, suitability, timeliness, and availability of the information, text, services, reports, videos, pictures, and related graphics contained on or obtained through the Website for any purpose. All such information, services, and related contents are provided “as is” without warranty of any kind. Talent Link and/or its respective partners hereby disclaim all warranties and conditions with regards to this information, services, and related contents, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement. 

Limitation of Liability 

Talent Link shall not be liable to you or any third person for any loss, injury, claim, liability or damage of any kind resulting from your use of the Website or the contents. Talent Link shall not be liable for any direct, indirect, special, incidental, exemplary, punitive, multiplied or consequential damages of any kind whatsoever (including, without limitation, attorneys’ fees) in any way due to, resulting from or arising in connection with the use of or inability to use the Website or, including, but not limited to, the Talent Link’s products and services, even if Talent Link is aware or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Talent Link’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the greater of the amount paid, if any, by you to Talent Link. Any claim or action regarding such liability shall be raised or commenced within ninety (90) days commencing on the day of such damage, otherwise, such claim or action is permanently barred. 

Third-Party Applications Disclaimer 

You acknowledge that your access and use of any third-party applications or software on the Website as part of Talent Link’s services and content (the “Third Party Applications”) is at your discretion and risk, and Talent Link has no liability to you arising out of or in connection with your use of the Third-Party Applications. Talent Link hereby disclaims any representation, warranty, or guaranty regarding the Third Party Applications, whether expressed, implied or statutory, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose, and any representation, warranty, or guaranty regarding the availability, quality, reliability, features, appropriateness, accuracy, completeness, or legality of the Third Party Applications, and you agree to indemnify and hold Talent Link harmless for any direct, indirect, punitive, incidental, special, or consequential damages, or any damages whatsoever including, without limitation, damages for loss of use, arising out of or in any way connected with the use or performance of the Third Party Applications. 

Modification of the Terms of Service 

Talent Link reserves the right to update or change the Terms of Service at any time. The terms, conditions, and notices for the Website services will update on the Website and are effective immediately. You are responsible for regularly reviewing the Terms of Services. Your continued access to or use of the Website after any such change shall deem your consent to such changes.
